If you’re a director or company secretary of an Irish-registered company, you may be interested to learn about a provision under Section 150(11) of the Companies Act 2014 that allows for the non-disclosure of residential addresses in exceptional circumstances.
What Is the Form T1 Exemption?
As a rule, all company officers in Irish companies must provide their residential address when acting in a company. This information is available on the public record.
The Form T1 application enables company officers to request that their residential address be withheld from the public record. This exemption is granted only in exceptional circumstances, typically where there is a genuine concern for personal safety or security.
Once approved, the Companies Registration Office (CRO) in Dublin will display the company’s registered office address instead of the officer’s home address on future filings.
Considerations for Existing Companies
It’s important to note that this exemption does not apply retroactively. Any documents previously filed with the CRO that include a director’s residential address will remain accessible on the public record.
How Common Is This Application?
The CRO does not publish Form T1 applications on the public file, so the number of exemptions granted is unknown. However, we have observed a notable increase in enquiries regarding this issue and have successfully completed several applications on behalf of directors.
If you believe this exemption may be relevant to you or to any Irish companies under your administration, please don’t hesitate to contact us at [email protected] We’re happy to answer any questions and guide you through the application process.
